With eleven (11) variances approved by the Municipal Land Use Board at their June meeting, the review board approved the final site plan for W&W Roselle Park LLC. The proposed project is across the street of borough hall on East Westfield Avenue and connects to Walnut Street.
The applicant returned after presenting the preliminary plan in May.
The attorney for the applicant, Meredith Marcus from Hehl & Hehl out of Union Township, presented the documents during the hearing.
Changes made from the previous hearing including reducing the height of the four-story eight (8) unit project from 53.7 feet to 51.25 feet. Additional signage for pedestrian safety was added and parking was amended to include lot 2 which is the existing law firm building. The required parking spaces for the use and size of the project was 25 but the applicant requested to have 21 spaces be acceptable and put in a parking variance for four (4) spaces.
After testimony was reviewed, the public portion had residents asking about traffic safety and emergency vehicle access, the MLUB voted on the application and unanimously approved nine (9) C variances, one (1) D variance, and two parking variances. The variances are listed below. The D variance was regarding height. Even though the actual building is within the B-3 Arterial Business District and has a height allowance of 72 feet, the parking area of the project abuts residential properties and according to 40-2404.1, whenever a lot or part of a lot in B-3 abuts a residential district, it shall be governed by the height regulations for the residential district.

The applicant will have to wait until July 26th to start any work to allow time for any legal appeals. None are expected.
