Seatbelt Violation Leads To CDS Possession Arrest

On February 5, 2011 at about 10:43 a.m., Patrolman Kevin Florczak observed a gray Honda with the driver not wearing a seatbelt in violation on 39:3-76.2F. A motor vehicle stop on Linden Road resulted in the discovery of two (2) small clear Ziplock bags containing suspected marijuana; one (1) partially smoked hand rolled cigar containing suspected marijuana; one (1) metal grinder containing suspected marijuana; one (1) one small metal cylinder containing suspected marijuana residue; and one (1) silver department of corrections badge, # N-313.

The driver, Amilcar Colon, age 38, of Plainfield, NJ was placed under arrest and charged with 2C:35-10(a)(4) (possession of marijuana); 2C:36-2 (possession of drug paraphernalia); 39:3-76.2F (failure to wear seatbelt); 39:4-49.1 (possession of CDS in a motor vehicle).

The badge was checked through the National Crime Information Center (NCIC) to determine if it was stolen, but revealed no record.

Mr. Colon was released pending a Roselle Park Municipal Court hearing on February 10, 2011.
