Reckless Driving Leads To CDS Charge

On December 3, 2010, at about 11:21 p.m., in the area of East Grant Avenue and Bender Avenue, Patrolman Kevin Florczak observed a brown Chevy driving carelessly causing officer Florczak to take evasive action in order to avoid a collision.

A motor vehicle stop on the 200 block of Bender Avenue led to the discovery of a small clear bag containing suspected marijuana located in the ashtray.

The marijuana was revealed when the driver, identified as Joseph Netta, age 19, of Roselle Park, NJ opened the ashtray of his vehicle and attempted put out his cigarette while speaking to officer Florczak.

An additional bag containing suspected CDS marijuana was discovered in the vehicle upon Mr. Netta’s arrest.

Netta was charged with 2C:35-10(a)(4) (possession of marijuana) and 2C:36-2 (possession of CDS paraphernalia) and traffic summonses for 39:4-97 (careless driving); 39:4-49.1 (possession of CDS in motor vehicle) and 39:3-13.4C (violation of provision drivers license conditions). He was released pending a Roselle Park Municipal Court hearing on December 9, 2010.
