On March 9, 2011 at approximately 9:45 p.m. on West Westfield Avenue, Patrolman Richard Gaylord observed a silver Acura in violation of 39:3-66 (rear brake light). A motor vehicle stop was initiated on Faitoute Avenue at West Clay Avenue. An investigation led to the discovery of a 200ml bottle of Hennessy Cognac on the rear passenger seat partially consumed and four (4) small Ziplock bags containing suspected marijuana.
The driver, Jose Gutierrez Jr., age 19, of Rahway, was arrested and charged with 2C:35-10(a)(4) (possession of marijuana); 2C:33-15A (possession / consumption of alcohol by a minor) and motor vehicle summonses for 39:3-66 (maintenance of lamps) and 39:4-49.1 (CDS found in motor vehicle).
He was released pending a Roselle Park Municipal Court date of March 17, 2011.
