Man Arrested For Assault After Breaking Into Former Apartment

On Monday, May 19, 2014 at 3:05 am, Patrolman John Fitzgerald, Patrolman Brian Macdonald, and Sergeant Michael Wielgus responded to an apartment complex on West Webster Avenue for a report of a burglary in progress. The caller reported that a male broke a first floor window and jumped into the apartment.

As police units arrived, officers found Herby Desir, age 26 from Elizabeth standing inside the apartment bleeding from cuts on his hands and arms. Desir refused to comply with police and had to be taken into custody at gunpoint.

The investigation revealed that Desir, a former occupant in the home, broke into the apartment and physically assaulted a former female roommate.

The victim suffered some swelling, bruising, and cuts to the face. He was charged with 2nd Degree Burglary, Simple Assault, and Criminal Mischief. Bail was set at $75,000.

Mr. Desir was ultimately treated medically and transported to the Union County Jail.
