On March 11, 2011 at approximately 9:29 p.m. in the area of Gordon Street and West Westfield Avenue, Patrolman Richard Gaylord observed a teal Kia in violation of NJ Motor Vehicle statute 39:3-66 (maintenance of lamps). A motor vehicle stop resulted in the discovery of an unsealed partially consumed bottle of Bacardi rum (1.75l), four (4) clear small Ziplock bags containing suspected CDS marijuana residue; one (1) wooden grinder containing suspected marijuana; one (1) medium sized clear sandwich bag containing suspected marijuana; and one (1) small Ziplock bag containing a blue tablet labeled “G” suspected to be Ecstasy.
The driver, Dontae Timothy, age of 21 and the passenger, Dajone Timothy, age 18, both of Rahway, NJ were arrested and charged with 2C:35-10(a)(4) (possession of marijuana); 2C:36-2 (possession of drug paraphernalia); and 2C:35-10(a)(1) (possession of Schedule II narcotic). The driver was also issued motor vehicle summonses for 39:3-66 (maintenance of lamps); 39:3-76.2F (seatbelt); 39:4-49.1 (CDS in motor vehicle) and 39:4-51B (open or unsealed alcoholic beverage in motor vehicle). Both were released pending a superior court date of March 18, 2011.
