Loud Muffler Violation Leads To CDS Arrest

On December 5, 2010 at about 10:02 p.m. on Faitoute Avenue at West Lincoln Avenue, Patrolman Kevin Florczak observed a gray Honda to be in violation of 39:3-70 (loud muffler) with smoke and 39:3-74 (view obstruction).

A motor vehicle stop on the 200 block of West Webster Avenue resulted in the discovery of (2) small bags containing suspected CDS marijuana and drug paraphernalia.

The driver, Jose Escobar, age 19, of Elizabeth was placed under arrest and charged with 2C:35-10(a)(4) (possession of marijuana) and 2C:36-2 (possession of drug paraphernalia) and motor vehicle summonses for 39:3-70 (loud muffler), 39:3-74 (obstructed view), and 39:4-49.1 (possession of CDS in a motor vehicle). Escobar was released pending a Roselle Park Municipal Court date of December 16, 2010.
