On August 10, 2011 at approximately 1:13 a.m., Sgt. David Pitts observed what appeared to be a male walking in the roadway after crossing West Westfield Avenue diagonally from Faitoute Avenue to Gordon Street. The male appeared to be a juvenile and therefore in violation of the borough’s curfew ordinance.
Sgt. Pitts approached the male who stated that he was 16 years of age. He was informed he was in violation of the curfew. While speaking to him, Sgt. Pitts was able to detect the odor of suspected burned marijuana coming from both his breath and his clothing.
An investigation led to the discovery of one (1) partially burned hand rolled cigar containing suspected marijuana.
The 16-year-old male of Elizabeth was placed under arrest and charged with 2C:35-10(a)(4) (possession of marijuana) and borough ordinance 3-17.1 (violation of curfew). He was later released to the custody of a parent pending a Union County Family Court hearing.
