Headlight Violation Results In CDS & Alcohol Arrest For Juveniles

On August 11, 2011 at approximately 1:06 a.m., Patrolman Richard Gaylord observed a green Honda Civic traveling westbound on West Westfield Avenue without its headlights on. A motor vehicle stop resulted in the discovery of a partially consumed Colt 45 40 oz. bottle of beer in between the legs of a 17-year-old male passenger of Elizabeth and one (1) clear plastic bag containing suspected marijuana in possession of the 16-year-old male driver of Elizabeth.

Both juveniles were placed under arrest and the vehicle was impounded.

The 17-year-old was charged with 2C:33-15(a) (underage possession of alcohol) and 39:4-51(a) (consumption alcohol in a motor vehicle).

The 16-year-old was charged with 2C:35-10(a)(4) (possession of marijuana), 39:3-47(a) (no headlights), 39:4-49.1 (CDS in a motor vehicle), 39:3-10 (unlicensed driver), and 39:3-66 (maintenance of lamps). He was released to the custody of a parent.
