On Tuesday, November 1, 2011, at approximately 12:12 p.m., Patrolman Robert Sobocinski observed a gold Nissan Sentra driving erratically changing lanes in violation of NJSA 39:4-88.
A motor vehicle stop on East Westfield Avenue at Pershing Avenue resulted in the discovery of one (1) partially consumed bottle of alcohol Ciroc Peach and one (1) small Ziplock bag containing suspected CDS marijuana.
The driver, Cesar Valdivia, age 23 of Clifton, NJ was placed under arrest and charged with 2C:35-10(a)(4) (possession of marijuana), 2C:36-2 (possession of drug paraphernalia), 39:4-88 (unsafe lane change), 39:3-76.2(f) (no seatbelt), 39:4-51(b) (open container of alcohol). Mr. Valdivia was released pending a Roselle Park Municipal Court hearing on November 3, 2011.
