Cellphone Use While Driving Leads To Arrest

On September 3, 2010 at 10:07 a.m., Patrolman Joshua Medrano observed an Acura traveling westbound on E. Westfield Avenue in violation of NJSA 39:4-97.3 (use of wireless device) near the intersection of Linden Road and E.Westfield Avenue. A motor vehicle stop resulted in the discovery of a partially smoked hand rolled cigar containing suspected marijuana, a silver grinder and a “Double Platinum Blunt Wrapper”.  Andres Bernal of Elizabeth was charged with 2C:35-10A(4) – (possession of under 50 grams of marijuana) and 2C:36-2.(possession of drug paraphernalia) and given a summons for 39:4-97.3 (use of wireless device) and 39:4-49.1 (possession of CDS in a motor vehicle).

Bernal was released pending a Roselle Park Municipal Court date of September 9, 2010.
