Cell Phone Use Violation Leads To CDS Charges

On Sunday, September 26, 2010 at approximately 2:26 p.m. on the 600 block of W. Westfield Avenue, Patrolman Nicholas Vaughan observed a black Honda Civic traveling westbound. The driver of the vehicle was speaking on a cellular phone which was held up to her left ear, in Violation of NJSA 39:4-97.3. The vehicle pulled into the Shell gas station at the corner of North Avenue and Grove Street, Cranford and Patrolman Vaughan conducted a motor vehicle stop in the parking lot. An investigation led to the discovery of three (3) partially smoked hand rolled cigars containing suspected Controlled Dangerous Substance (CDS) marijuana, one (1) small clear/black empty Ziplock bag and one (1) empty “Paul Masson” brandy bottle. Arnita Lee of Roselle was placed under arrest and charged with 2C:35-10A4 (possession of CDS), 2C:36-2 (possession of drug paraphernalia), 39:4-97.3 (use of wireless device), 39:4-49.1 (CDS in motor vehicle), and 39: 4-51(b) (open container of alcohol). Lee was released pending a Roselle Park Municipal Court first appearance of October 7, 2010.
