Cell Phone Use Violation Leads To Arrest

On Saturday, February 26, 2011 at approximately 1:27 p.m. Patrolman Nicholas Vaughan observed a green Toyota Corolla on the 700 block of Galloping Hill Road. The driver of the vehicle was talking on his cell phone in violation of 39:4-97. A motor vehicle stop on Galloping Hill Road at Grant Avenue led to the discovery of an open Baccardi bottle in the vehicle. The driver, Daniel Alvarez, age 21 of Linden,  was found to be in possession of one (1) small partially smoked hand rolled cigar containing suspected marijuana  and one (1)  pink/clear small Ziplock bag containing suspected marijuana residue.

Alvarez was placed under arrest and charged with 2C:35-10(a)(4) (possession of CDS) and 2C:36-2 (possession of drug paraphernalia).  He was also issued motor vehicle summonses for 39:4-97.3 (cell phone); 39:4-49.1 (possession of CDS in a motor vehicle) and 39:4-51(b) (open container of alcohol).  He was released pending a Roselle Park Municipal Court appearance on March 3, 2011.
